| In 28 of July of 2006, the Community of Madrid approved a very significant rule related to the building & demolition waste management field. We are talking about the 2690/2006 Order, which introduced measures so advanced as the permission to the councils to require, together with the building license application, a Building & Demolition Waste Management Plan, included in the technical project, and the requester obligation to deposit a bail calculated by the Council Technical Services, as a warrant for the appropriate management of the waste created in the work, bail that would be returned, after proving documentally the good management of this waste. This rule wasn¿t applied in many councils of the Community of Madrid, supposedly because they don¿t have the material and technical resources for implementation. But also, against it, the Architects Official Association of Madrid give notice of appeal, solved with the sentence 619/2008 (6 of May), pronounced by the Administrative- Contentious Room of The Madrid Superior Court., who declares the voiding of that Order, interpreting that the Order should be previously informed by the Association, as it is a technical law, regarding building and urbanizing. Later, for the whole country, RD 105/2008 (1 of February), which regulates the building & demolition waste management, was issued. It includes a set of novelties about the above mentioned regulation, even if it also presents common aspects with it. This address analyzes both regulations, using a comparison technique, finding similarities and differences between them, their positive aspects and deficiencies, always focused on the necessity of taking on account, for the development of these regulations, the indispensable participation of the technical experts who work on the building and urbanizing field. | |
